Pool, Gym and Clubhouse to Remain Closed Per CA Department of Public Health

At the Board meeting held on May 21st, the Board discussed the reopening of the community’s amenities, including the pool, gym and Clubhouse. There is currently a lot of confusion amongst community associations as to whether and how soon HOA’s may “reopen” their swimming pools in light of governmental COVID-19 restrictions. This confusion has arisen because of highly unclear and often internally inconsistent guidance both at the state and local level. However, California’s Department of Public Health (“CDPH”) has finally publicized clear standards for swimming pools. The CDPH website, available at https://covid19.ca.gov/roadmap-counties/, states that “the following sectors, businesses, establishments, or activities are not permitted to operate in the State of California at this time: … Community centers, public pools, playgrounds, and picnic areas.” Section 65503 of Title 22 of the California Code of Regulations defines “public pools” to include all homeowners association swimming pools. The only exception is private pools that serve not more than 3 residential units. In summary, as of May 19, 2020, HOAs anywhere in California are not permitted to open their community pools. If a community decides to reopen its pool at this time, it would run the risk of enforcement by health authorities and, of course, heightened liability in the event the pool transmits the infection. Pools are anticipated to open as part of “Phase 3”, however, the State has not yet provided unequivocal word on when swimming pools will be allowed to reopen. 

This situation is rapidly evolving, and as soon as there is clear guidance from the government as to when community association pools and other amenities may reopen and under what circumstances, the Board will consider reopening the amenities. We will keep all residents apprised of any updates.

Termite Exterior Inspections Scheduled May 27 – June 4, 2020

Dear Nevis Milano Residents,

Since 2016, the Association has contracted with Accurate Termite and Pest Control to perform the termite inspections of the interiors and exteriors of all units in May, which also includes local treatment if termites are found. The units are all covered under warranty, so if any termite activity is reported, Accurate will inspect and treat the unit at any time at no charge.

Due to the COVID-19 situation, the Board has opted to do a modified agreement this year in which Accurate will only perform the exterior inspections and treatment, which they will be doing from Wednesday, May 27th, through Thursday, June 4th. However, all units will continue to be covered under warranty through May 2021. If you notice termite activity in or around your unit, please contact Action Property Management’s Community Care Department and a work order will be sent to Accurate to inspect and treat the unit, which will be at no charge to the homeowner or HOA.

Please also not that under this program, Accurate will also perform termite inspections at no charge for escrows, so please make sure to contact them directly if you need to schedule a termite inspection during an escrow. Make sure to mention you are a Nevis Milano homeowner so that they do not apply a charge.

Pool, Spa, Gym and Clubhouse Closed Due to COVID-19

The Association’s pool and spa, gym, and Clubhouse will be closed until further notice due to the directive from the Orange County Department of Public Health in order to limit the risk of exposure to COVID-19. We will notify all residents when the facilities will be re-opened for use. Clubhouse reservations will be suspended until further notice.

We sincerely apologize for any inconvenience these facilities closures cause and greatly appreciate your understanding and cooperation during this difficult time as we strive to protect residents from exposure to this virus.
